Terms of Use

By accessing or using this website or any applications (including mobile applications) made available by the Nuclear Insurance Association of Canada and its members (“NIAC”, “we” or “us”), you agree to be bound by these Terms of Use.  Please read them carefully.

The Terms of Use are to be read by you together with any terms, conditions or disclaimers provided in the pages of the NIAC website.  If there is any inconsistency between these Terms of Use and the additional terms, the additional terms will prevail to the extent of the inconsistency.

If the need arises, we reserve the right to modify or terminate the NIAC website, or your access to the NIAC website for any reason, without notice, at any time, and without liability to you.

We reserve the right, in our sole discretion, to change these Terms of Use from time to time.  Changes may be made to the Terms of Use at any time without notice by updating this posting.  You agree that your use of the NIAC website after the effective date of the updated terms constitutes your agreement to the updated terms.

You may not use content from the NIAC website unless you obtain permission from its owner or are otherwise permitted by law.  The information on this site is for your personal use only.  Any unauthorized downloading, re-transmission, or other copying or modification of contents of the site subject to copyright may be a violation of federal legislation or other law that may apply to copyright and could subject the copier to legal action.  These terms do not grant you the right to use any branding or logos used in our website.

In connection with your use of our website, we may send you service announcements, administrative messages and other information.  You may opt out of some of those communications.

Commentary and other materials posted on our site are not intended to amount to advice on which reliance should be placed. We therefore disclaim all liability and responsibility arising from any reliance placed on such materials by any visitor to our site, or by anyone who may be informed of any of its contents.

By using this website, you acknowledge and agree that the website (including without limitation, its content) is provided on an “as is, where is” basis, and that any use of or reliance on the site shall be at your sole risk.  Any of the material on our site may be out of date at any given time, and we assume no obligation to update the content on the site.

The material displayed on our website is provided without any guarantees, conditions or warranties as to its accuracy. To the extent permitted by law, we hereby expressly exclude:
All conditions, warranties and other terms which might otherwise be implied by statute, common law or the law of equity.

Any liability for any direct, indirect, incidental, special, consequential, exemplary or punitive loss or damage incurred by any user in connection with our site or in connection with the use, inability to use, or results of the use of our site, any websites linked to it and any materials posted on it, including, without limitation any liability for: loss of income or revenue; loss of business; loss of profits or contracts; loss of anticipated savings; loss of data; loss of goodwill; wasted management or office time; and for any other loss or damage of any kind, however arising and whether caused by tort (including negligence), breach of contract or otherwise, even if foreseeable.

To the extent permitted by law, the total liability of NIAC and its service providers for any claims under these Terms of Use, including for any implied warranties, is limited to the amount that you paid us to use the website (or, if we choose, to supplying you with the website again).

These Terms of Use govern the relationship between NIAC and you. They do not create any third party beneficiary rights.

If you do not comply with these Terms of Use and we do not take action immediately, this doesn’t mean that we are giving up any rights that we may have (such as taking action in the future).

If it turns out that a particular term is not enforceable, this will not affect any other terms.
